THE FOLLOWING ARE TERMS AND CONDITIONS OF A LEGAL AGREEMENT BETWEEN YOU AND SPOOKYHAUNTING.COM.
The use of this site is governed by the policies, terms and conditions set forth below. Please read them carefully. By accessing, browsing and/or using this web site, you acknowledge that you have read, understood and agree to these terms and conditions. Your placement of an order indicates your acceptance of these terms and conditions. If you don’t agree with these terms and conditions, don’t use this web site. SpookyHaunting.com reserves the right to make changes to this site and these terms and conditions at any time.
1. RETURNS - ( Return to top )
Returns and exchanges are handled on an INDIVIDUAL BASIS and approved at the SOLE DISCRETION of management. The following are general guidelines. Returns and exchange policy applies, but is not limited to the following situations:
1. You’ve received your order and want to make an exchange for a different item(s)
2. You’ve received the wrong item(s)
3. There’s a problem (damaged or defective) with the item(s)
4. You are unhappy with your purchase
There is a $10.00/25% (whichever is greater) RESTOCKING FEE calculated on the total amount of the item(s) ordered plus shipping, on all items (unless received damaged, defective or wrong item) and this fee will be applied to your refund. You are responsible for SHIPPING COSTS BOTH WAYS.
To begin the return or exchange process, you must first notify customer service via email within 48 hours after your receipt of the order to request a Return Authorization Number (RAN). A RAN must be obtained from customer service prior to sending your return back to us. Returns will not be accepted UNDER ANY CIRCUMSTANCES, unless you have a RAN. Please include the following information in your message:
1. The topic “Returns and refunds”
2. Your name
3. Your complete mailing address
4. Your email address
5. Your order number
6. The description of the item(s)
7. A brief description of the problem
8. If the item is damaged, defective or you’re unhappy with your purchase, you must send with this email some pictures of the item you wish to return for evaluation purposes.
We cannot proceed to any returns or exchanges unless we have some PICTURES of the item(s) in question.
Our receipt of your claim doesn’t signify our acceptance of the return/exchange. SpookyHaunting.com reserves the right to decline your claim for any reason. If we accept your claim, then we will email you the specific instructions on how and where to make your return and will give you your RAN. Print it, and send it with your package back to the address given with the instructions. All returnable goods must be returned to the originating supplier or manufacturer. If you are unable to print, please write all the applicable information on your own sheet of paper. We will reply to all e-mails within 1 business day.
All returned and exchanged items must be returned using the following guidelines:
1. Item(s) must be returned within 10 days after a RAN has been issued. RETURNS AFTER 10 DAYS WILL NOT BE ACCEPTED.
2. Item(s) must be received in like-new and unused condition and not missing any items (including the original packaging).
3. The RAN must be written clearly on the outside of the box. Returns received without an RAN NUMBER WRITTEN CLEARCLY ON THE OUTSIDE OF THE PACKAGE will be refused back to the sender.
4. All mailed returns must be sent via a traceable method and must have delivery confirmation to confirm that your return has been delivered to us.
5. It is your (the customer’s) responsibility to insure the returned item(s) in the event of loss or damage.
Packages will be refused (at the customer's expense) if merchandise is returned without first sending us proper notification within the stipulated time period and receiving a reply back from us with the appropriate information which will include a Return Authorization Number (RAN).
Please allow 2 to 4 weeks processing.
a) RETURNS FOR EXCHANGES - ( Return to top )
For exchanges, if the order is returnable, you can send it back to receive the replacement item, not to be refunded (you still need a RAN). Restocking Fee will be applied for the returned item. You are responsible for the cost of the shipping and handling for the original item and the replacement item. You must place a new order for the needed replacement item. This is because the desired item may be out of stock by the time we receive your return and to ensure the fastest delivery of your replacement item. If it is a wrong size costume sent we will exchange for a different size only. All appropriate policies apply to all returned items.
b) RETURNS FOR WRONG OR DEFECTIVE ITEM(S) - ( Return to top )
If you order one item but receive a different item, we will replace the wrong item with the correct item on an "even exchange" basis only. The replacement will be with the original item as it was originally ordered. If the item is defective, we will replace it with another one or make a full refund in the event that the item has become out of stock. You don’t have to place a new order for the needed replacement item. There will be no restocking fee and the shipping charges will be at our expense. All appropriate policies apply to all returned items.
c) RETURNS FOR REFUNDS - ( Return to top )
If you’re unhappy with your purchase, you need to follow the return process by notifying customer service. We reserve the right to decline your claim for any reason. If we accept your claim, you can send it back to be refunded for the cost of the item. You are responsible for SHIPPING COSTS BOTH WAYS. All appropriate policies apply to all returned items including restocking fees.
Any return received with missing items will be credited minus the missing item(s). Please double-check that you have included all of the items and packaging prior to mailing your return to us.
Due to the nature of some merchandise sold, the fact that some individuals use costumes (and other items) once and then try to return them, as well as U.S. Department of Health regulations pertaining to the mail order sale of hats, wigs, masks, clothing, etc., all returns must be in original packaging and look as in new condition. The item(s) will be sent back to you if the packaging is torn or missing or if we feel they have been worn and used no credit will be issued. If someone opens an item we cannot resale it. Sorry, there is no exception to this policy.
Any orders returned with out any means of tracking or delivery confirmation will be considered an unauthorized return and we are not responsible for refunding the order if we cannot verify receipt of the return.
The following items are non-returnable: All Costumes, lingerie, masks (including all prosthetics), wigs, beards, hats, teeth, make-up, hair spray, magic supplies, books, videos, CDs, DVDs (if package has been opened), special orders for large animatronics, special order items and sale items, UNLESS RECEIVED DEFECTIVE. We are sorry for any inconvenience this may cause.
Our regular return policy applies to returns that are received in our office no later than October 1st and orders placed after November 15. Orders can be returned (between October 1st-November 15th) if the item is returned unused, in original condition, and with all the original packaging.
d) RETURNS FOR WRONG SIZE COSTUME / MASK - ( Return to top )
We do not guarantee that a particular costume, mask or any other item will fit you. Due to the fact that all People are unique in size and shape we can not guarantee that a particular costume or mask will fit a particular person. Be absolutely certain that you order the proper costume (dress, shirt, pants, etc.) size as it is always indicated in the costume description. We will not exchange the costume with a different size or style if we did, in fact, send you what you ordered even if it doesn’t fit.
Also note that if the costume only comes in one size (for example "one size fits most" or “standard adult size”) we will not replace it as there is no other size available. "One size fits most" or “standard adult size” is not the same as "one size fits all".
If it becomes necessary for you to return a costume for "even exchange", any item returned for any reason must be returned following our RETURN POLICIES.
e) RERTURNS FOR DAMAGED ITEM(S) - ( Return to top )
Please open and inspect your order immediately upon receiving it and contact us immediately if there’s a problem. If you would like to make a return because of a damaged item, then there will be no restocking fee and we will send a new item to you or make a full refund in the event that the item is out of stock. All merchandise is packaged with care and we are not responsible for damages during transit. PRODUCT DAMAGE CLAIMS MUST BE MADE TO SPOOKYHAUNTING.COM WITHIN 2 DAYS OF DELIVERY VIA EMAIL. Please sign for your order noting any damage to cartons or boxes. SpookyHaunting.com will not replace (at our expense) any damaged shipments where we are not notified within 48 hours of your receipt of your order.
If there is a damage claim, please save all packaging, take pictures and report it immediately directly to us. The carrier is responsible for any shipment that is lost or damaged during transit. We will file a claim with UPS and send a new item to you at our expense. Since we are not sure on what UPS will do about the damaged item, you should hold onto it until the new one is delivered. Please allow 2 to 4 weeks processing. If an order arrives by UPS and is signed for and accepted, it is the responsibility of the customer. SpookyHaunting.com will not be responsible for any stolen or damaged shipments that are required to be delivered by UPS without a signature.
Items cannot be returned after 30 days from receipt except during Halloween season (September & October) as these returns should be made after the season.
2. ORDER CANCELLATIONS - ( Return to top )
If you need to cancel an order for some reason, please do so as quickly as possible. Because we want you to receive your order as soon as possible, our automated ordering system prints orders for immediate processing. For that reason, we usually cannot make changes to your order once it has been submitted on our web site. Please double-check all of your address information, products ordered, and the shipping method you have selected prior to completing your order.
Order cancellations may be REQUESTED, and we will do our best to cancel your order before it ships, however we CANNOT GARANTEE that your order will be cancellable due to time constraints.
Orders placed after October 21st CANNOT BE CANCELLED for any reason. In the event that your order doesn’t arrive to you by October 31st if order is placed after October 21st, WE WILL NOT BE HELD RESPONSIBLE for the delay.
3. PLACE YOUR ORDER EARLY - ( Return to top )
For your Halloween item(s), we suggest that you place your order early (before the 1st of October) to ensure that you will receive it and can still return it (if needed) prior to the date of your Halloween event. We want you to be happy with your purchase, so place your order early.
4. ORDER ACCEPTANCE POLICY - ( Return to top )
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. SpookyHaunting.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. SpookyHaunting.com reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. In the event that your order must be cancelled due to an inventory shortage, miscount, or pricing error you will be notified of the order cancellation and we will issue a charge credit for the cost of the item(s).
All orders placed over $10 000 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.
When a customer places an order either for themselves or on behalf of another individual, business, etc., SpookyHaunting.com will accept the order based on the customer reading and understanding all of the terms of sale found in the Terms and Conditions sections of our web site before placing the actual order. Should the customer have any questions pertaining to any terms of sale as stated herein, they should contact us via email before the order is placed.
5. COLLECTION FEES - ( Return to top )
If we must resort to using a collection agency, legal council, or any legal proceedings to attempt to collect monies owed to us by you, it is understood and agreed to by you (the customer), that you will be responsible for any and all collections, chargebacks, legal fees, etc.

SpookyHaunting.com shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the Province of Quebec in Canada. Each Canadian customer shall be solely responsible for all sales taxes, Custom Duties and al other related fees.
9. JURISDICTION AND VENUE - ( Return to top )
You agree that any legal action brought against SpookyHaunting.com shall be governed by the laws of the Province of Quebec in Canada without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the SpookyHaunting.com site shall be an appropriate state court located in Quebec City.

All products sold on this website are intended for entertainment purposes only and are intended to be used by adults or with close adult supervision. SpookyHaunting.com, its president, officer/or other representatives, the vendors, suppliers, and manufacturers that have posted their merchandise on this web site, will not be responsible or held liable for any personal injury, damage, or loss, may they be indirect, consequential, or punitive, from any product purchased from this website that is used or misused in any manner.
SpookyHaunting.com, it's owner, and the various suppliers, vendors, and manufacturers that have advertised their merchandise on the SpookyHaunting.com web site will not be held accountable for any unauthorized payments for merchandise made via PayPal, personal or business checks, money orders, etc. It is the sole responsibility of the customer to safeguard their PayPal, credit card, debit card, checking account and/or banking information from unauthorized use. This stipulation will take priority over any and all agreements that the customer may have made with PayPal, any credit card company, and any banking institution.
Products that are not manufactured by SpookyHaunting.com are not inspected or warranted by SpookyHaunting.com. SpookyHaunting.com is solely a distributor of products that are not manufactured by SpookyHaunting.com. Any product purchased from Haunting SpookyHaunting.com being used in any event open to the general public or otherwise, should be inspected by your local Fire Marshal and Safety Inspector to make sure that it complies with safety and fire codes.

From time to time manufacturers make changes or alterations to products without notifying us. These changes are due to the manufacturer’s production and availability of materials. These changes, no matter how slight, are beyond our control. We apologize for any inconvenience this may cause. Manufacturers do not always notify vendors of these variations. We are not responsible for such changes and we do try our best to keep the descriptions as accurate as possible. Pictures of the products on our web site are not the ones of the actual items that we ship. Some differences in color and other details may vary and we are not responsible for such differences. We will reflect any changes to the products in the website descriptions and images as soon as we become aware of them. THANK YOU FOR YOUR UNDERSTANDING WITH THIS ISSUE.
